Construction Disputes in New Jersey: Know Your Rights as a Property Owner

Construction projects in New Jersey frequently give rise to disputes — over workmanship, delays, unpaid invoices, and contract terms. Whether you are a homeowner dealing with a contractor who abandoned a job or a business owner facing cost overruns and defective work, understanding your legal options is essential.

New Jersey's Consumer Fraud Act (CFA) provides strong protection for homeowners in residential construction disputes. Contractors who misrepresent the scope of work, fail to perform promised repairs, or demand payment for work never completed may be liable under the CFA for triple damages and attorney's fees. New Jersey also requires residential contractors to be registered under the Contractors' Registration Act — and a contractor's failure to register is itself a CFA violation. For commercial construction disputes, breach of contract and breach of warranty claims are the primary avenues, along with claims under the New Jersey Construction Lien Law for unpaid subcontractors and suppliers.

Mechanic's liens — known in New Jersey as construction liens — provide contractors, subcontractors, and suppliers a powerful tool to secure payment by attaching a lien to the property. Property owners facing a lien must understand strict deadlines for challenging it. Conversely, property owners with defective work claims must act promptly given New Jersey's statutes of limitation. Ahmad & Hussain Law Group represents both property owners and construction professionals in New Jersey construction disputes, providing skilled litigation counsel and working toward efficient resolutions.
